Orcus Technology provides web services to subscribers worldwide, and all customers must adhere to the following Terms and Conditions of Service. The terms of service outlined below are designed to ensure the highest level of service possible. This Orcus Technology Terms Of Service agreement (hereinafter referred to as the “TOS”) establishes the terms and conditions under which Orcus Technology’s Services (hereinafter referred to as the “Services”) will be delivered to you following your registration. You confirm that you are at least 18 years old. The TOS clearly defines what is and is not permitted with the Services. This TOS is not exhaustive, and Orcus Technology reserves the right to change it at any time, with notice published at https://orcustech.com. No employees of Orcus Technology, verbal or written agreement/statement, or anything on the Orcus Technology website, will take precedence over the TOS. The Customer agrees to all the terms and conditions of the TOS, as changed from time to time, in their entirety by registering for and using any of Orcus Technology Services. The Customer is responsible for his or her clients if he or she resells or represents the Services for which he or she is paying. Only the Customer who is paying for the Services is recognized by Orcus Technology, not his or her clients. Violation of the TOS or any other activity deemed inappropriate by Orcus Technology may result in the Customer’s Services being terminated or suspended.
New Accounts
We’ll set up your account once we’ve received payment and screened the order(s) for fraud by ourselves and/or our payment partner(s). You have to supply us with an email address that is not @ the domain(s) under which you are registering. If there is ever an abuse issue or we need to contact you, we will use the primary email address on file. You must always keep the email address on file up to date and current. You must ensure that the contact information for your domain account and your actual domain name(s) are valid and up-to-date if you have a domain name registered with Orcus Technology. Orcus Technology is not responsible for a lapsed registration caused by the domain being paired with outdated contact information. If you need to double-check or alter this information, go to your clients’ section and make the changes yourself. Your account may be terminated if you provide fraudulent contact information of any type. Within 3 days of establishing your account with Orcus Technology, you must present government-issued identification (Passport/National ID/Driving License, etc.) and proof of address (Utility Bill) for any service purchased from Orcus Technology. If you don’t meet these standards, your order may be flagged as fraudulent and refused. New account setup may be delayed due to unanticipated challenges with numerous mail servers and connection problems between your ISP and Orcus Technology operating office.
Transfers
Our migration staff will do all possible to assist you in moving your site to us. However, our migration team provides transfers as a best-effort service, and we cannot guarantee the availability, possibility, or time required to execute an account transfer. Each hosting firm is set up differently, and some hosting platforms save data in an incompatible or proprietary format, making migration of some or all account data exceedingly difficult, if not impossible. We will do our utmost to help you move data from a previous host, but we may not be able to do so in some situations. The free transfer services are accessible for three (3) days after you sign up.
Satisfaction Guaranteed
Only the Web Hosting service is covered by a 14-day guarantee. If you are dissatisfied with the services for any reason during the first 14 days of service (Only Web Hosting), you may request that your services be terminated in writing via email or our cancellation form (see below), and you will receive a full refund*. You must also give a specific explanation for your cancellation (as we request any cancellation, no matter the time frame). We are the only arbitrator of whether your reason is valid and if you and we both took all reasonable steps to correct the problem that caused the interest to be canceled. Payments
When you subscribe to our services, you are signing up for a pre-paid service, and all ITES (domain registration, web hosting, SSL, and so on) services are may subject to 5% VAT, or VAT and sales tax for web development services. All past-due invoices can be paid online with Bangladeshi Payment Method, or PayPal and Stripe for International Clients, as well as via bank transfer . Except for payments made through our offline method, all online payments are subject to a payment gateway fee, which will be added automatically when you select payment options in your Clients Area > Invoice. From 30 to 1 day before the renewal date, renewal notices are sent numerous times through email. If your yearly charge is declined and we are unable to contact you, the late fees to authorize your account will apply. We shall take the following steps if a shared/reseller/VPS/Dedicated/Email Server/Spam Filtering/File Hosting, etc. account has a past due invoice.

2 Days – Accounts are suspended
7 Days – Late Fee Added
15 Days – Accounts will be terminated
Cancellations
To cancel your services with Orcus Technology, please submit a written request to our sales department or use the cancellation option in your client area.
Overage Charges
Orcus Technology’s service plans are designed to meet the majority of usage scenarios. If your account requires additional resources beyond the allocated limits, we will not automatically charge your card. It is your responsibility to keep your cPanel email address up to date to receive notifications about reaching specific limits. Failure to upgrade your account upon reaching these limits may result in the suspension of your site.
Refunds/Accounts Termination
If Orcus Technology fails to provide services, a prorated refund will be granted. However, no refunds will be given if your services are suspended or terminated due to a violation of our policies. Account cancellations will result in suspension followed by data erasure within 14 days. If an account is suspended for over 10 days for reasons other than cancellation, it will be erased. Orcus Technology reserves the right to suspend all accounts if one or more remain unpaid.
Content
All Orcus Technology services must be used for legitimate purposes. Prohibited content includes copyrighted material, threats, obscene material, material that jeopardizes national security, and content that violates trade secrets or other laws. We do not allow content related to hate, racism, harassment, or illegal activities. Forbidden content also includes IRC scripts, proxy scripts, pirated software, image hosting scripts, and more.
Resource Usage Policy
Shared hosting accounts must not consume excessive server resources, and usage must be monitored. Violations may result in an offer to upgrade to a dedicated server. Illegal usage, content, or distribution of software is not allowed.

Orcus Technology strictly prohibits the use of its services for the following activities:

3. Pirated Software/Warez
4. Image Hosting Scripts
5. AutoSurf/PTC/PTS/PPC sites
6. IP Scanners
7. Bruteforce Programs/Scripts
8. Mail Bombers/Spam Scripts
9. Banner-Ad services
10. File Dump/Mirror Scripts
11. Commercial Audio Streaming (more than two streams)
12. Escrow/Bank Debentures
13. High-Yield Interest Programs (HYIP)
14. Investment Sites (FOREX, E-Gold Exchange, etc.)
15. Sale of controlled substances without proper permits
16. Prime Banks Programs
17. Lottery Sites
18. Hateful/Racist/Harassment-oriented sites
19. Hacker-focused sites/archives/programs
20. Promotion of illegal activities or distribution of pirated/illegal content
**Shared Hosting-Specific Policies:**
1. Shared hosting accounts are not for backup/storage purposes.
2. Usage of more than 70% of total disk space for file storage is considered unusual.
3. Orcus Technology reserves the right to monitor systems for lawful reasons.
4. Access to third-party networks requires clear written permission.
**Email Marketing and Spam Policy:**
1. Opt-in email marketing is permitted with explicit consent from recipients.
2. Unsolicited commercial email (spam) is strictly prohibited.
3. Email marketing content must include legitimate contact information and unsubscribe options.
**Script Usage Policy:**
1. CGI, PHP, and executable scripts must not consume excessive system resources.
2. Scripts must be secure, promptly run, and not designed to attack the server.
3. Chat room scripts in Perl and high-resource scripts are forbidden.
4. Scripts violating policies may result in account suspension or termination.
**Server Resource Abuse Policy (SRAP):**
1. Excessive server resource usage may lead to an upgrade to a dedicated server.
2. Orcus Technology on average memory use, CPU use, Apache connections, MySQL connections, emails per hour, and server-side processes are enforced.
**Illegal Usage and Content:**
1. Use of Orcus Technology servers for illegal purposes or content is strictly forbidden.
2. Orcus Technology maintains the right to determine violations and may terminate accounts accordingly.
**Software Distribution and IP Address Ownership:**
1. Distribution of software or multimedia materials using Orcus Technology hosting accounts is not allowed.
2. Orcus Technology retains ownership and control of assigned IP addresses.
**Liabilities and Security:**
1. Orcus Technology is not liable for client services and will not take action on dubious material unless reported.
2. Users must not attempt to violate Orcus Technology Network’s security, leading to legal consequences.
**Server Abuse Policy:**
1. Any attempt to harm Orcus Technology servers or subscribers is strictly prohibited.
2. Users are liable for all acts on their accounts, whether performed by them or others.
**Bandwidth and Traffic Measurement Policy:**
1. Monthly traffic allowances are based on a 50/50 split of incoming to outgoing traffic.
2. Users exceeding traffic limits may be charged overage fees.
These terms are in place to ensure a secure, fair, and efficient hosting environment. Violations may result in account suspension or termination.
Scheduled Maintenance and Downtime
Orcus Technology strives to provide 24/7 services, but downtime may occur due to maintenance, upgrades, or unforeseen issues. Scheduled downtimes are communicated in advance.
Responsibility (Reseller/Client)
Clients are responsible for all activities originating from their accounts. A basic understanding of internet languages and protocols is required. Clients are responsible for their website’s design and maintenance.
Backups
Orcus Technology recommends users backup data regularly. Shared hosting accounts have a complimentary remote backup option, while VPS/Dedicated server users must devise their backup plan.
Actions
Account deactivation may occur for policy violations. Orcus Technology reserves the right to suspend or terminate accounts based on the severity of violations.
Refusal of Service
Orcus Technology has the right to refuse, cancel, or stop service, especially in cases of policy violations, spam, script abuse, or unreasonable customer behaviour.
General
Orcus Technology’s service is subject to change without notice. Charges are nonrefundable, except within the 30-day money return guarantee. Orcus Technology may terminate accounts with notice or delete accounts with 15 days’ notice.
